What's protected

These names belong to us. Please don't use them in your own business, signage, ads, social media, or domain names without written permission. If your business has a similar name and you got there independently, get in touch and we'll figure it out.
Copyrighted content
The writing, photos, illustrations, video, layout, and code on this website are original work created for Clear the Air. Copying any of it onto another site, into a brochure, or onto social media without permission is copyright infringement, even if the source is credited.
Things people sometimes assume that aren't true
Most people who copy material from a small-business website aren't trying to be malicious. They've just been told something incorrect about what's allowed. A few of the more common ones:
"It was on the internet, so it's free"
The internet is a publishing medium, not a license to reuse. Almost everything published online is copyrighted by default the moment it's created.
"I gave them credit"
Attribution is polite, but it's not the same as permission. Crediting the source doesn't make the copy legal.
"I changed it a little"
Rewriting a paragraph, recoloring an image, or cropping a photo doesn't reset the copyright. Derivative works are still derivative works.
"I'm not making money from it"
Non-commercial use isn't automatically fair use. Whether it's for a blog, a school project, or a competitor's website, the rules are the same.
"It was already on someone else's site"
If they didn't have the right to use it, you don't either. Two copies don't cancel each other out.
"I didn't know it was protected"
Copyright protection is automatic. Nothing has to be marked with a © symbol to qualify.
If we find something that shouldn't be there
We monitor the use of our brand and content. If we find one of our photos, paragraphs, or marks somewhere it shouldn't be, here's what usually happens:
- We send a friendly note asking for it to be taken down. Most of the time, that's the end of it.
- If the material isn't removed, we follow up with a formal cease-and-desist letter from our attorney.
- If that gets ignored, we have the option to file a copyright or trademark infringement lawsuit. Federal statutory damages and legal fees can be significant.
We'd much rather skip all that. If you got this far because you're worried about something on your own site, just reach out. A two-minute email solves almost every situation.
