The basic ground rules for using this website and for hiring us to service your HVAC. Written in plain language so you can actually read it.

Using this website

You're welcome to read, link to, and share anything on this site. In return, we ask that you don't do anything that breaks the site or misuses our content.

  • Don't scrape, copy, or republish our content without permission. (See our copyright notice.)
  • Don't try to break the site, probe it for vulnerabilities, or use it to send spam.
  • Don't impersonate Clear the Air or pretend a form submission is from someone other than yourself.

Hiring us for service

Estimates and quotes

Quotes for service work and equipment are valid for 30 days from the date issued unless we say otherwise in writing. Prices for repair parts can change if a manufacturer raises the price between quote and order, we'll tell you before we proceed.

Authorization to perform work

Before we start any repair or installation, we'll explain what we're going to do and what it costs, and you'll authorize the work, on paper, by signature, or electronically. We don't do work you haven't approved. If we discover something during a job that changes the scope (a hidden refrigerant leak, a damaged duct), we stop and call you before going further.

Payment

Payment is due when the work is complete unless you've signed a financing agreement or a service contract with payment terms. We accept cash, check, and major credit cards. Returned checks and declined payments are subject to a $35 fee plus any bank charges we incur.

Warranties

Our standard installation labor warranty is one year. Equipment warranties are set by the manufacturer (typically 5 to 10 years on parts, longer for compressors and heat exchangers when you register the equipment). Repair work is warranted for 365 days (1 year) on parts and labor. Specific warranty details are on your invoice and supersede this summary.

What our warranty doesn't cover

Damage from power surges, lightning, flooding, lack of maintenance, modifications by other contractors, or use of the equipment outside its design conditions. If a flood took out your condenser, we'll help you replace it but we can't warranty it as a repair.

Cancellations and rescheduling

Service appointments can be rescheduled at no charge with at least 4 hours' notice. After-hours and emergency dispatch is non-refundable once a tech is en route. Equipment installations can be rescheduled up until 48 hours before the install date; after that, we may charge a restocking fee for special-order equipment.

Your responsibilities as a customer

  • Provide safe access to the equipment, including pets secured and a clear path to the unit.
  • Tell us about known hazards on the property (wasps, rotten attic decking, electrical issues).
  • Provide accurate billing and contact information.
  • Pay the invoice when the work is complete (or per your financing or service contract terms).

Our limitations of liability

We're a small HVAC company doing our best to do the work right. We carry general liability and workers' compensation insurance and we stand behind our work, but the law lets us draw a few sensible lines:

  • Our liability for any single job is limited to the amount you paid us for that job, except where Texas law requires otherwise.
  • We aren't liable for indirect or consequential damages (lost food in a refrigerator, lost business income, hotel costs while a system is down) unless we caused them through gross negligence.
  • We aren't liable for delays caused by weather, parts shortages, manufacturer back-orders, or events outside our reasonable control.
  • Pre-existing problems with your home (electrical issues, framing, drainage, building code violations) are not our responsibility to remedy unless you've hired us to do so.

Disputes

If something goes wrong, we want to fix it. The fastest way to a real solution is to call our office and ask for the owner. Most issues get resolved in one phone call.

If we can't work it out, these terms are governed by Texas law. Any formal dispute is filed in Brazoria County, Texas. Both sides agree to attempt mediation before filing suit when the amount in question is under $25,000.

Changes to these terms

We update this page from time to time. The effective date is in the badges at the top. Material changes are announced on our homepage for at least 30 days before they take effect for new customers; existing service contracts and signed proposals remain governed by the terms you agreed to at the time.
